About The Firm
Ellenberg Gannon Henninger & Fitzmaurice, LLP was formed by Michael A. Ellenberg and was originally known as Ellenberg & Hutson, LLP, which was established in 1989. David Gannon became a partner in January 2007. On November 1, 2017, John Henninger and Stacy Fitzmaurice joined the firm as partners in a merger with Geisler, Henninger and Fitzmaurice, LLP. The firm consists of four partners and four associates.
The firm's practice is focused on the defense of professionals, including physicians and hospitals, dentists, nurses, physicians’ assistants, medical and dental clinics, professional misconduct defense, premises liability, general liability, as well as insurance coverage and regulation and appellate practice.
In addition to professional and general negligence cases, the firm has represented a number of hospitals in general premises liability matters, as well as other entities, including domestic and international insurance companies and their insureds. The firm also focuses on the defense of construction claims and accidents, products liability, general liability, employment and labor, property damage and casualty actions.
Having practiced at firms of all different sizes before starting Ellenberg, Gannon Henninger & Fitzmaurice, LLP, including at LeBoeuf, Lamb, Leiby and MacRae where Mr. Ellenberg achieved great notoriety, it was Mr. Ellenberg’s goal to create a firm that would offer clients the best of both worlds the professionalism, quality, and responsiveness of a large firm, and the familiarity and savings of a small firm.

Mr. Ellenberg has successfully defended at trial obstetricians, neurologists, and other physicians in high exposure, alleged brain damage and other injury cases since 1989. Mr. Henninger has also been actively defending physicians at trial since his first verdict in 1992. In addition, Mr. Gannon and Ms. Fitzmaurice all possess first hand trial experience with medical malpractice cases.
